Supreme Court quashes MP High Court ‘Tie Rakhi for Bail’ order

New Delhi, 18 March: The Supreme Court has quashed the decision of the Madhya Pradesh High Court to grant bail to the accused of sexual harassment with the condition of tying a rakhi to the victim.

A bench headed by Justice AM Khanwilkar advised the judges to avoid any form of stereotyping.

During the hearing on this matter, Attorney General KK Venugopal had said that there is a need to sensitize the judges of the trial court and the High Court. Nine women lawyers had approached the Supreme Court against the order of the Madhya Pradesh High Court. It was said in the application that such conditions of the court in the case of sexual abuse add further to the suffering of the victim.

โ€œEarlier, the trial court also gave bail to the accused by getting a rakhi tied to the victim girl. In such a situation, the Supreme Court should decide whether the courts can give such instructions in the terms of the bail,โ€ said AG.
