Allahabad HC seeks reply from UP govt over validity of Nazul Ordinance within 4 weeks

Prayagraj, March 21: The Allahabad High Court considered the petition challenging the validity of the Nazul Ordinance of the UP government as maintainable and today issued a notice to the Advocate General to present the government’s side. The court has also sought a reply from the state government within four weeks and has sought a reply from the petitioner within two weeks.

The information given by the Chief Permanent Advocate through ADM Nazul Prayagraj is currently being surveyed. There will be no harassing action against the petitioners nor any demolition. On this, the court has said that no harassing action will be taken against the petitioners.

This order has been given by the division bench of Justice SD Singh and Justice Surendra Singh while hearing the petition of Hemant Gupta, Sunil Gupta and former High Court judge Dilip Gupta. Senior Supreme Court advocates Abhishek Manu Singhvi, Tarun Aggarwal and state government’s chief standing counsel Kunal Ravi presented their side on the petition through video conferencing.

The petitioner says that there are court decisions regarding Nazul land. There is an order to consider the application which is pending before the government. In such a situation, the ordinance brought is giving effect to the decisions of the court and its purpose is to defeat the orders of the court.

The ordinance arbitrarily takes away the legal rights of the petitioners. It was argued that the decree had been passed in the Ashok Tahliani and Amarnath Bhargava cases. The application is pending before the government. Therefore, interim relief should be considered. Through the ordinance, the government has banned freeholding of Nazul land. Which has been challenged.
