Washington (USA), August 30: A US federal appeals court has made an important comment on President Donald J. Trump’s global tariffs in a 7-4 majority decision on Friday. The decision said, “Most of President Donald Trump’s global tariffs are illegal.”
According to the news of ABC News Channel, the US Appeals Court for the Federal Circuit rejected ‘most of the powers’ of Trump’s right to impose tariffs. The federal court agreed with the lower court and said that Trump’s steps are “invalid because they are contrary to the law”. However, the federal court postponed its decision till mid-October. Its purpose is that the Trump administration can appeal to the Supreme Court. The federal court has said that the tariffs will remain in effect until the Supreme Court orders.
“We agree that the President’s authority to ‘regulate’ imports by International Emergency Economic Powers Act does not authorize tariffs imposed by executive order. We affirm,” the majority decision read. In the decision, the appeals court determined that only Congress has the authority to impose tariffs.
Seven of the 11 judges on the appeals court said that this rarely used law does not give Trump the authority to impose his “reciprocal” tariffs or the “smuggling” tariffs imposed on Canada, Mexico and China. Four judges involved in the majority decision even said that the International Emergency Economic Powers Act (IEEPA) does not give Trump the authority to issue any tariffs.
The US Court of Appeals for the Federal Circuit heard oral arguments on the tariffs in July.
President Donald Trump reacted sharply to the decision on his social media platforms on Friday evening. Trump condemned the appeals court’s decision and warned that the court’s order blocking the tariffs would actually destroy the United States. Not only this, Trump urged the Supreme Court to give a decision that he (the President) has the right to impose unilateral tariffs. Trump wrote, “Now with the help of the Supreme Court of America, we will use it for the benefit of our nation and make America prosperous, strong and powerful again.”
