UP Gangsters Act constitutional validity challenged in SC

New Delhi, 6 December: A petition has been filed in the Supreme Court challenging the constitutional validity of the UP Gangsters Act. The petition challenges the validity of registration of FIRs under the Act.

The petition has also challenged the provision of 60 days police remand of the accused and the right of the police to acquire the property of the accused. The petition claims that the police are misusing the Gangster Act.

The petition states that re-registration of FIR under the UP Gangsters Act against the person who committed the offense despite the fact that FIR has already been registered against him in that case is violative of Section 20(2) of the Constitution.
