Shri Krishna Janmabhoomi case: SC seeks written arguments from both the parties

New Delhi, 10 November: The Supreme Court, while hearing the case challenging the transfer of the cases related to Shri Krishna Janmabhoomi dispute case to Allahabad High Court, asked both the parties to file written arguments.

The bench headed by Justice Sanjay Kishan Kaul said that it will consider the legal aspect of the High Court order related to the transfer.

During the hearing, the Muslim side said that the distance between Mathura and Allahabad is about 600 kilometers whereas the distance to Delhi is about 100 kilometers, hence the case should be transferred to Delhi instead of Allahabad. The Muslim side opposed the transfer citing funds and distance as the reason behind it.

Then the court said that the demand to transfer the case to Delhi High Court is not right, because the workload in Delhi High Court is already huge.

On July 21, the Supreme Court had directed the Registrar of Allahabad High Court to submit the list of cases related to Shri Krishna Janmabhoomi case.

The court had said that considering the importance of the case, hearing in the High Court seems appropriate.

In fact, the Shahi Idgah Mosque Management Committee of Mathura has challenged the order of the Allahabad High Court in the Shri Krishna Janmabhoomi-Shahi Idgah dispute.

On May 26, Allahabad High Court had transferred all the cases related to Shri Krishna Janmabhoomi dispute to itself.

The Mosque Committee has demanded cancellation of this order. It has been said in the petition that the decision of the High Court is not correct on the basis of facts and law. The petition states that this order will also take away the petitioner’s statutory right of appeal, as it is eliminating the two appellate stages of the trial.

The Allahabad High Court, while transferring all the cases going on in the lower court of Mathura in the Shri Krishna Janmabhoomi case, had said that the High Court will hear all the cases related to Shri Krishna Janmabhoomi.

However, the Hindu side has already filed a caveat petition in the Supreme Court in this matter.
