“You created an ISIS-like Whatsapp group”, Supreme Court denies bail to accused in custody for 2 yrs under UAPA

New Delhi, November 11: The impact of the blast near the Red Fort was also seen in the Supreme Court’s decisions. On Tuesday, the Supreme Court refused bail to an accused who had been in custody for more than two years under the Unlawful Activities (Prevention) Act (UAPA). A bench headed by Justice Vikram Nath ordered the dismissal of the bail plea.

Senior advocate Siddharth Dave, representing the petitioner, began his arguments by saying that today was not a good morning to argue the case. Justice Vikram Nath then asked why. Justice Sandeep Mehta said that this was the best morning to send a message.

During the hearing, the court asked that it was an accepted fact that objectionable material was recovered from the petitioner. Dave then replied that only Islamic literature was recovered.

During the hearing, Justice Mehta remarked that you created an ISIS-like WhatsApp group. What more are you looking for? What was the motive behind this?

Dave then said that the protected witness said that the NIA was pressuring him to give false testimony and that he did not want to testify. Justice Mehta then said, “Leave the witness aside, speak about the material that was recovered.”

Dave said that the petitioner has been in custody for two and a half years. Justice Mehta then said, “You are accused of creating a circle of terror in the country.”

The court said that preparing for a conspiracy would fall under the UAPA. Dave then said that no RDX or explosive material had been recovered. The petitioner is 70 percent disabled. The court then asked whether he was mentally or physically disabled. The court then rejected the bail plea and directed the trial court to complete the trial within two years.
