Allahabad HC denies to stay on demolition of Sambhal mosque

Prayagraj, October 4: The Allahabad High Court did not give any relief on the petition seeking stay on the demolition of Masjid Sharif Gausulbara Rawan Buzurg.

Refusing to intervene, the court directed the petitioner to file an appeal before the district magistrate (DM) under Section 67 against the action related order.

On Saturday, Justice Dinesh Pathak heard the petition of Masjid Sharif Gausulbara Rawan Buzurg and others. The court has ordered the Collector to dispose of the application for interim order on merit.

Advocates Arvind Kumar Tripathi and Shashank Shree Tripathi argued on the petition and on behalf of the government, Additional Advocate General Sanjeev Singh, Chief Standing Counsel II J N Maurya and Standing Counsel Ashish Mohan Srivastava argued. โ€œSection 67(5) of the Uttar Pradesh Revenue Code, 2006 provides for the filing of an appeal before the competent court, i.e., the Collector, as an alternative remedy.

Failing to obtain relief on the petition, the petitioner’s counsel requested permission to withdraw the petition to seek alternative legal relief. He stated that he would file an appeal before the Collector. The government did not object to the withdrawal of the petition, which the Court granted. The petition challenged the order passed by the Assistant Collector, First Class-Tehsildar, Sambhal, on September 2, 2025.

Before concluding the case, the petitioner’s counsel requested interim protection. The Court stated that it was open to the petitioners to file an appropriate application before the Appellate Court for interim protection.

The Court also directed that any application filed by the petitioners would be considered and decided by the Appellate Court on its merits, in accordance with law, without prejudice to the order passed by this Court.
