Haryana govt notifies Contracted Employees (Service Security) Rules

Chandigarh, August 6: The Haryana Government has notified the Haryana Contracted Employees (Service Security) Rules, 2025, which have been implemented under Section 10 (1) of the Haryana Contracted Employees (Service Security) Act, 2024. With this, the services of thousands of employees working in various departments, boards, corporations and authorities of the state have been secured.

After the notification issued in this regard by Chief Secretary Anurag Rastogi, the government spokesperson said on Wednesday that any contracted employee will have to complete at least five years of service by August 15, 2024, in which he should have received a minimum of 240 working days’ salary in each year to get the status of ‘safe employee’. If an employee has been employed in both higher and lower posts in the same year, the service will also be counted, provided he has drawn 240 days’ pay.

In particular, employees who were earlier appointed to regular posts but their services were terminated due to cancellation or revision of merit list by Haryana Staff Selection Commission, their previous service on regular basis, excluding the break period between regular and contractual service, will also be included in the eligibility of 5 years. Also, service rendered in different departments or bodies under the control of the State Government will be clubbed seamlessly.

If a person is married to a person whose spouse is alive or who has married a person despite having a living spouse, he will not be eligible for the benefit of service protection under the Act.

If the corresponding post is easily identified, a ‘supernumerary’ post will be created by the Government organisation for the protected employee with effect from August 16, 2024. If a corresponding post cannot be identified or the nomenclature of the post of the eligible contractual employee is different from the existing sanctioned regular post, a proposal for creation of ‘additional post’ with the proposed designation, pay scale, required educational qualification and job description will be sent to the government by the concerned government organization with effect from August 16, 2024. This proposal will be approved by the government in consultation with the Finance Department within 90 days and thereafter an order of service security will be issued.

If the number of secured employees in any department is more, their list will be sent to the government and they will be adjusted in other departments as per requirement. The appointing authority will have the right to transfer any secured employee within or outside Haryana in public interest.

For determination of remuneration, after adding increment at the rate of 5 per cent or 10 per cent or 15 per cent, as the case may be, to the minimum of the functional pay level approved by the Finance Department at the time of sanctioning the supernumerary post, the figure obtained shall be rounded off to the nearest 100. For this purpose fractions below 50 shall be ignored while fractions of 50 and above shall be rounded off to the next 100.

Secured employees will get annual increment once a year in the functional pay level. The date of increment shall be 1st January or 1st July every year, provided the employee has completed qualifying service of at least six months before that date. The first increment shall be payable on 1st July, 2025, on completion of eligibility. These employees will also be paid dearness allowance equal to regular employees from January 1, 2025. These employees will continue to get casual leave and medical leave as before. Women reserved employees will get two casual leaves every month and a maximum of 22 days in a year, whereas earlier they used to get only 10 casual leaves.
